By Linda Sutter – September 18, 2021 On September 9, 2021 the Crescent City Harbor District filed a lawsuit against Crescent Fire Protection District for determination of invalidity. CCHD is challenging the CFPD for the adoption of Ordinance No. 21-001. The Ordinance is a property based assessment subject to the procedural and substantive limitations of Article X111D . Article X111D requires record owner of each parcel to be given written notice by mail. CCHD did not receive any written notice whatsoever and in fact their ballots were labeled as undeliverable by the post office on June 28, 14 days after the election. Interestingly enough the CCHD had not changed their address since the failed prior election of CFPD which occurred in October 2020. Postmaster Vargas was alerted to this matter in August and is conducting her own investigation as to what occurred with the ballots not getting delivered in a timely fashion as the CCHD address had not changed.
