Walters pleaded guilty to accessory after the fact for helping his son, 17-year-old Russell Walters Jr., evade arrest following a shooting at the Jedediah Smith Shopping Center on May 28, Micks told Redwood Voice Community News on Tuesday. There was no viable evidence to support additional charges against Walters Sr., the district attorney said. As part of a plea negotiation, Walters Sr., who appeared before Judge Karen Olson on Monday, received a 150-day initial jail sentence, according to Micks. The defendant had already spent 72 days in jail and was given a “conduct credit” of 72 additional days, which means he served a total of 144 days in jail against that 150-day sentence, Micks said. Russell Walters Sr. will also be on one year of informal probation with up to an additional 215-day jail sentence if he fails to “obey all laws,” Micks said. Father and son were arrested in the Sacramento County-community of Citrus Heights on June 8 about a week after the shooting. According to Crescent City Police Chief Richard Griffin, his department was pursuing attempted homicide charges against the younger Russell Walters, who was the primary suspect. One victim had been hospitalized with a gunshot wound to the abdomen as a result of the shooting. On Tuesday, Micks said the case against Russell Walters Jr. is being processed in juvenile court, which is closed to the public. She said she’s unsure of what the timeline will be for that case. “My ultimate goal is to hold junior accountable as much as I can,” she said. A third suspect, Joshua Roberts, was arrested following the shooting incident. Griffin told Redwood Voice that Roberts had helped the two suspects leave Del Norte County. According to Micks, Roberts pleaded no contest to possession of ammunition by a felon and accessory after the fact, both misdemeanors and was sentenced to credit for time served of 144 days.
