The primary purpose of the proposed Ordinance is to limit City liability; the secondary goal of the pump track is to promote a thriving economy. Health and Safety Code limits the liability of public agencies that requires riders to wear helmets, elbow and knee pads and the prominent posting of signage notifying of the requirement. Courtesy Photo The Pump Track Ordinance is a “hazardous recreational activity.” Upon adopting the Ordinance, the City’s liability will be limited to its duty to maintain the track in a safe condition. Liability is limited to injuries or damages for using the track for its intended purpose.Children under the age of 12 must be supervised by an adult.
