 By Gun Owners of California – July 25, 2025 – Picture Credit to Las Vegas Shooting Center Amazingly, the Ninth Circuit — a court that’s rarely been friendly to the Second Amendment — has now ruled in favor of California gun owners in three separate GOC-backed gun rights cases in just the last two months. That includes the one-gun-a-month law, the youth advertising restrictions, and now… the ammunition background check law. Today, in the case of Rhode v. Bonta, a 2-1 panel of the Ninth Circuit struck down California’s ammo background check law, finding it unconstitutional under the Bruen standard. The court reinstated Judge Benitez’s permanent injunction, stating clearly that the law violates the Second Amendment and should not be enforced. What does this mean for you, our member? Can you buy ammo without a background check right now? As of this moment, we’re very close… but we're not quite there yet. For now, the ammo background check law technically remains in effect, but that could change very soon — even in a matter of days — depending on what happens next in court. Here’s what’s happening behind the scenes: Even though the Ninth Circuit ordered the injunction to be reinstated, that ruling still has to be processed by the lower court, and the state is almost certain to file a motion asking the Ninth Circuit to keep the stay in place while they try to get an en banc rehearing — that means a larger panel of Ninth Circuit judges could potentially revisit the case. We’re working closely with our partners at CRPA, including the incredible team at Michel & Associates, to get clarity from the courts and push for immediate enforcement of the ruling. This case is a big deal. It proves again that California’s anti-gun laws cannot survive under proper constitutional scrutiny.
